TERMS OF SERVICE - ANYONE HAS A PRICE
1. INTRODUCTION AND ACCEPTANCE
1.1 Platform Description
Anyone Has a Price (referred to as "we," "us," "our," "the Platform," or "the Company") is a digital platform that allows fans to make paid custom requests to creators, with payments held securely until fulfilled. The Platform connects fans with creators who have linked their Instagram accounts to our service.
1.2 Binding Agreement
THESE TERMS OF SERVICE CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND ANYONE HAS A PRICE. PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM. BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE PLATFORM.
1.3 Acceptance Through Use
By creating an account, accessing, or using the Platform in any manner, you affirm that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and any other policies referenced herein, which are incorporated by reference.
1.4 Modification of Terms
We reserve the right to modify these Terms at any time at our sole discretion. WE WILL NOTIFY ALL USERS VIA EMAIL AND PLATFORM NOTIFICATIONS OF ANY MATERIAL CHANGES TO THESE TERMS AT LEAST 30 DAYS BEFORE SUCH CHANGES TAKE EFFECT. Your continued use of the Platform after the effective date of such changes constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically. The most current version of the Terms will always be available on the Platform.
2. DEFINITIONS
2.1 "Platform" or "Company"
Refers to Anyone Has a Price, operated by Anyone LLC, a company registered in Wyoming, USA, and its website, mobile applications, services, tools, and features.
2.2 "User" or "Fan"
Refers to any individual who accesses or uses the Platform to make requests to Creators.
2.3 "Creator"
Refers to any individual who has linked their Instagram account to the Platform and receives requests from Fans.
2.4 "Services"
Refers to all services provided by the Platform, including but not limited to facilitating connections between Fans and Creators, processing payments, holding funds securely, and providing communication tools.
2.5 "Content"
Refers to any text, images, videos, audio, or other material uploaded, shared, or transmitted through the Platform by Users or Creators.
2.6 "Secure Payment Holding"
Refers to the temporary holding of funds by the Platform for security purposes until a request is fulfilled by a Creator. THE PLATFORM DOES NOT OPERATE AS A FIDUCIARY OR ESCROW AGENT AND HOLDS FUNDS SOLELY FOR SECURITY AND TRANSACTION FACILITATION PURPOSES.
2.7 "Dispute"
Refers to a formal complaint filed by a Fan claiming that a Creator has not fulfilled a request as agreed.
2.8 "Offer" or "Request"
Refers to a specific paid request made by a Fan to a Creator through the Platform.
2.9 "Payment"
Refers to any monetary transaction processed through the Platform.
2.10 "Instagram Profile Data"
Refers to publicly available information from Instagram accounts, including but not limited to profile pictures, usernames, and other public profile information that is displayed on the Platform for identification purposes only.
3. ELIGIBILITY AND REGISTRATION
3.1 Age Requirements
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old.
3.2 Account Creation
To use the Platform, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.3 Instagram Account Linking and Identity Verification Limitations
IMPORTANT NOTICE REGARDING IDENTITY VERIFICATION: Creators must link their Instagram account to the Platform. This linking process requires authorization through our Linking systems. We do not ask for your Instagram password.
THE PLATFORM ONLY VERIFIES THE CONNECTION TO AN INSTAGRAM ACCOUNT AND DOES NOT VERIFY THE ACTUAL IDENTITY OF THE PERSON OPERATING THE ACCOUNT. Users acknowledge and accept that:
a) We verify only the technical connection to an Instagram account b) We do not verify government-issued identification c) We do not confirm that the person operating the Instagram account is the same person shown in profile photos d) THE PLATFORM IS NOT RESPONSIBLE IF ANOTHER PERSON IS USING AN INSTAGRAM PROFILE WITHOUT AUTHORIZATION e) Users engage with profiles at their own risk regarding identity authenticity
3.4 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3.5 Accuracy of Information
You represent and warrant that all information you provide to the Platform is accurate and complete. Providing false or misleading information may result in immediate termination of your account.
4. PLATFORM SERVICES
4.1 Service Description
The Platform provides a digital space that allows Fans to make paid custom requests to Creators. The Platform facilitates connections, handles payments through secure holding, and provides communication tools.
4.2 Secure Payment Holding System
The Platform holds all payments securely until a request is fulfilled by a Creator. FUNDS ARE HELD FOR SECURITY PURPOSES ONLY AND NOT AS A FIDUCIARY ESCROW SERVICE. Once a Creator marks a request as fulfilled, the funds are released to the Creator after any applicable waiting period.
4.3 Communication Tools
The Platform provides end-to-end encrypted communication tools for Fans and Creators to discuss requests. These communications may be decrypted by the Platform only in the event of a dispute.
4.4 Creator Discovery and Instagram Profile Display
4.4.1 Public Information Usage and Opt-Out Mechanism
The Platform displays public information from Instagram accounts, allowing Fans to discover and connect with potential Creators. ANY INDIVIDUAL MAY REQUEST REMOVAL OF THEIR PROFILE FROM OUR PLATFORM AT ANY TIME THROUGH OUR REMOVAL FORM AT: https://www.anyonehasaprice.com/removal-form
This information is sourced solely from publicly available Instagram profiles and is used strictly for identification purposes only. WE COLLECT AND USE ONLY PROFILE PICTURES, INSTAGRAM HANDLES, AND BASIC PUBLIC PROFILE INFORMATION FOR IDENTIFICATION PURPOSES ONLY.
4.4.2 Non-Affiliation with Instagram
IMPORTANT NOTICE REGARDING INSTAGRAM: Anyone Has a Price is an independent platform that is NOT affiliated with, endorsed by, sponsored by, or in any way officially connected with Instagram, Meta Platforms, Inc., or any of their subsidiaries or affiliates. Instagram and Meta are registered trademarks of Meta Platforms, Inc. We operate as a completely separate service that allows users to make offers to individuals who have public Instagram profiles.
4.4.3 No Implied Endorsement or Participation
IMPORTANT NOTICE REGARDING INSTAGRAM PROFILES: The Instagram profiles displayed on our platform are: (a) Sourced exclusively from publicly available information; (b) Displayed solely for discovery and identification purposes; (c) Not indicative of any relationship between the profile owner and Anyone Has a Price; (d) Not an implication that the profile owner is aware of, has consented to, or participates in our platform; (e) Not an endorsement by the profile owner of our platform or services; (f) Subject to immediate removal upon request by the profile owner.
The display of profile information is limited to the minimum necessary for identification purposes and constitutes fair use under applicable law. We make no representations regarding the currency or accuracy of the displayed information.
4.4.4 Profile Display Limitations
The display of Instagram profile information is limited to the minimum necessary for identification purposes and does not constitute commercial exploitation of any individual's likeness, name, or identity beyond the limited purpose of facilitating potential connections between Fans and Creators.
4.4.5 Right of Publicity Acknowledgment
We respect the right of publicity and personal image rights of all individuals. Our use of publicly available Instagram profile information is conducted in accordance with fair use principles and is not intended to suggest any endorsement or ongoing relationship with the Platform.
We acknowledge that the right of publicity and personal image rights vary by jurisdiction. We respect these rights globally and will promptly honor any valid claim regarding unauthorized use of name, image, or likeness in accordance with applicable local laws.
4.4.6 Profile Removal Procedure
PROFILE REMOVAL: If you are an Instagram user whose profile appears on our platform and wish to have it removed, simply fill out our opt-out form at https://www.anyonehasaprice.com/removal-form. Our team will process your request promptly. For expedited removal or other concerns, you may also contact us via:

PERMANENT EXCLUSION: Upon request, we will implement technical measures to prevent your profile from being redisplayed on our platform in the future.
We respect your right to control how your public information is used and are committed to honoring all legitimate removal requests promptly.
4.4.7 Offer Totals Transparency
All offer totals displayed on profiles are aggregated from user-submitted offers and do not indicate whether the recipient has viewed, accepted, declined, or is even aware of these offers. These totals are displayed solely to provide transparency about platform activity and should not be interpreted as indicating any action or engagement by the profile owner.
4.4.8 Enhanced Instagram Non-Affiliation Disclaimer
ADDITIONAL DISCLAIMER REGARDING INSTAGRAM AFFILIATION: To eliminate any possible confusion about our relationship with Instagram or Meta Platforms, Inc., we explicitly state that:
a) We are not a Meta/Instagram partner, affiliate, or authorized service provider b) Instagram/Meta has not approved, endorsed, or sponsored our platform c) Our service operates independently of Instagram's terms of service d) Instagram/Meta bears no responsibility for our platform's operations e) Any issues with our platform should be directed to us, not Instagram/Meta f) We do not represent Instagram/Meta in any capacity
4.5 Request/Offer System
Fans can make custom offers with specific prices to Creators. Creators can accept or decline these offers at their discretion.
4.6 Legal Basis for Processing
LEGAL BASIS FOR PROCESSING: Our display of publicly available Instagram profile information is based on:
1.Legitimate interest in providing a service that allows users to discover and connect with potential creators;
2.The public nature of the information as deliberately made available by Instagram users;
3.The minimal processing limited to what is necessary for identification purposes;
4.The implementation of robust opt-out mechanisms that respect data subject rights;
5.Our careful balancing of interests that considers the reasonable expectations of Instagram users.
We continuously assess this balance and will modify our practices if this assessment changes.
Our limited display of publicly available Instagram profile information constitutes fair use under applicable copyright and intellectual property laws, as it is:
1.Transformative in nature, serving a different purpose than the original;
2.Limited to publicly available information;
3.Not a substitute for the original Instagram profile;
4.Not negatively impacting the potential market for or value of the original content;
5.Used for the socially beneficial purpose of facilitating connections between creators and fans.
5. USER CONDUCT AND RESPONSIBILITIES
5.1 Prohibited Activities
By using the Platform, you agree not to engage in any conduct that is unlawful, abusive, or disruptive to the operation or integrity of the service. Specifically, you shall not:
a) Violate any applicable local, national, or international laws, regulations, or third-party rights; b) Impersonate any person or entity, or falsely state or misrepresent your affiliation with any individual or organization; c) Harass, threaten, stalk, intimidate, or otherwise interfere with the privacy or rights of other users; d) Upload, post, transmit, or otherwise make available any content that is illegal, harmful, abusive, defamatory, obscene, hateful, or otherwise objectionable; e) Attempt to bypass, avoid, or manipulate the Platform's payment or secure holding system in any way; f) Use the Platform to engage in or promote any form of fraud, scam, or unauthorized commercial activity; g) Interfere with, disrupt, or adversely affect the operation, security, or accessibility of the Platform or any related systems or networks; h) Attempt to gain unauthorized access to any portion of the Platform, including but not limited to, private accounts, communications, or data not intended for you; i) Use, develop, or deploy automated tools, bots, scripts, or data extraction software (such as web scraping or crawling technologies) without express written permission from the Platform; j) Engage in any activity that, in our sole discretion, may damage, disable, overburden, or impair the Platform's infrastructure or the experience of other users; k) Falsely claim or imply that any Instagram user endorses, participates in, or is affiliated with the Platform without their explicit consent; l) Make any claims or representations suggesting that any Instagram user whose profile appears on our Platform has endorsed, approved, or is affiliated with our Platform unless they have explicitly done so; m) Use our Platform to harass, stalk, or repeatedly contact Instagram users who have not expressed interest in receiving offers.
Violations of these provisions may result in immediate suspension or termination of your account, legal action, and reporting to law enforcement authorities where appropriate.
5.2 Content Restrictions
You agree not to upload, post, share, or transmit through the Platform any content ("Content") that, in whole or in part:
a) Violates any applicable law or regulation, or is otherwise illegal, harmful, threatening, abusive, harassing, defamatory, libelous, or an invasion of another's privacy; b) Infringes, misappropriates, or violates any intellectual property right, proprietary right, or the right of publicity or privacy of any third party; c) Contains viruses, malware, corrupted data, or any other harmful, disruptive, or destructive files, code, or programs; d) Constitutes unsolicited or unauthorized advertising, promotional materials, spam, pyramid schemes, or any other form of solicitation not expressly authorized by the Platform; e) Provides or purports to provide regulated services such as medical, legal, financial, or other professional advice, unless expressly permitted and in compliance with all applicable licensing and regulatory requirements; f) Depicts, involves, references, or appears to involve any individuals under the age of 18, in any context, whether explicit or otherwise—such content is strictly prohibited and will result in immediate account termination and potential legal action; g) Falsely implies endorsement by or affiliation with any individual whose profile appears on the Platform.
The Platform reserves the right to remove any content that, in its sole discretion, violates these terms or poses a risk to the safety, legality, or integrity of the service.
5.3 Communication Guidelines
All communications between Fans and Creators must be conducted through the Platform. Sharing external contact information to circumvent the Platform's payment system is prohibited.
5.4 Account Security
You are responsible for maintaining the security of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
5.5 Accuracy of Information
You must provide accurate and complete information when using the Platform. You are responsible for updating your information if it changes.
5.6 User Acknowledgment and Consent
By using our Platform, you explicitly acknowledge and agree that:
1.You understand that Instagram profiles displayed on our Platform may belong to individuals who have not registered with or consented to appear on our Platform;
2.You will not make any claims or representations suggesting that any Instagram user whose profile appears on our Platform has endorsed, approved, or is affiliated with our Platform unless they have explicitly done so;
3.You understand that making offers to Instagram users through our Platform does not guarantee their awareness of, interest in, or response to such offers;
4.You will not use our Platform to harass, stalk, or repeatedly contact Instagram users who have not expressed interest in receiving offers.
6. CREATOR SPECIFIC TERMS
6.1 Creator Verification and Identity Limitations
To register as a Creator on the Platform, users must link a valid Instagram account through our secure authentication process. This linking confirms control over the associated Instagram profile at the time of registration.
IMPORTANT IDENTITY VERIFICATION LIMITATIONS: This process constitutes the sole verification method used by the Platform. WE DO NOT INDEPENDENTLY VERIFY THE IDENTITY OF CREATORS BEYOND THEIR INSTAGRAM ACCOUNT LINKAGE. We do not guarantee the continued ownership or control of the linked Instagram account, and WE ARE NOT LIABLE FOR ANY MISREPRESENTATION, IMPERSONATION, OR SUBSEQUENT ACCOUNT COMPROMISE.
Users interact with Creators at their own discretion and acknowledge that the Platform makes no representations or warranties regarding the true identity, authenticity, or qualifications of any Creator.
6.2 Request Fulfillment
Creators are solely and fully responsible for completing the requests they accept from Fans. The terms of fulfillment are determined through direct communication between the Fan and the Creator. The Creator has the exclusive authority to determine when a request has been completed, which is done by marking the request as "fulfilled" on the Platform.
The Platform does not evaluate, verify, or guarantee the quality, accuracy, or completeness of the Creator's fulfillment. By using the Platform, Fans acknowledge that the Platform's role is strictly limited to facilitating transactions and communications, and we do not intervene unless a formal dispute is submitted and accepted for review.
6.3 Payment Receipt
Payments are processed through Stripe and held securely until a request is marked as fulfilled by the Creator. Funds are typically released to Creators within 5-14 days after a request is marked as fulfilled, provided no dispute is filed.
6.4 Tax Obligations
Creators are solely responsible for reporting and paying all applicable taxes on income earned through the Platform. The Platform may provide tax documentation as required by law.
6.5 Content Ownership
Creators retain ownership of all Content they create in fulfillment of requests. By fulfilling requests through the Platform, Creators grant Fans a non-exclusive license to use the Content for personal, non-commercial purposes.
6.6 Non-User Instagram Profiles
The Platform may display Instagram profiles of individuals who have not registered as Creators on the Platform. These profiles are displayed solely to facilitate the offer process and do not indicate that these individuals are active users of the Platform, have endorsed the Platform, or have any relationship with the Platform.
If an offer is made to an Instagram user who is not registered on the Platform, they will receive an invitation to join. They are under no obligation to accept this invitation or any offers made through the Platform.
7. PAYMENTS AND FEES
7.1 Payment Processing
All payments on the Platform are processed through Stripe. The Platform does not store credit card information.
7.2 Currency
All payments on the Platform are processed in US Dollars (USD). If your bank account is in a different currency, Stripe may apply currency conversion fees. These conversion fees are determined by Stripe and are not controlled by the Platform. You are responsible for any currency conversion fees applied by Stripe or your financial institution.
7.3 Platform Commission
The Platform charges a 20% commission on all transactions. This commission is deducted from the payment before it is released to the Creator.
7.4 Secure Payment Holding Process
When a Fan makes a request, the full payment amount is captured as an authorization and charged immediately when the request is accepted and held securely by the Platform until the request is fulfilled by the Creator. FUNDS ARE HELD FOR SECURITY PURPOSES ONLY AND NOT AS A FIDUCIARY ESCROW SERVICE.
7.5 Payment Release Conditions
Payments are released to Creators when: a) The Creator marks a request as fulfilled; and b) No dispute is filed by the Fan within the applicable timeframe; or c) A dispute is resolved in favor of the Creator.
7.6 Refund Policy
COMPREHENSIVE REFUND POLICY: All offers and payments are generally final once a Creator has accepted the offer, except in the following circumstances where refunds are available:
REFUNDS ARE AVAILABLE IN THE FOLLOWING CIRCUMSTANCES: a) Fraud: If fraudulent activity is detected or proven b) Failure to Deliver: If a Creator fails to deliver the agreed-upon service as specified c) Platform Error: If a technical error results in incorrect charges d) Creator Non-Response: If a Creator accepts an offer but fails to respond within 7 days e) Misrepresentation: If a Creator materially misrepresents their ability to fulfill a request f) Pre-Acceptance Cancellations: If a Fan cancels a request before it is accepted by the Creator, no funds are captured, and the authorization is simply voided g) Creator Rejection: If a Creator declines a request or explicitly cancels it after acceptance, the payment authorization is voided or refunded in full
Refund Process: Refund requests must be submitted within 30 days of the original transaction. The Platform reserves the right to investigate all refund claims and may require evidence of non-fulfillment. False dispute claims or abuse of this system may result in account penalties or bans.
7.7 Future Payment Methods
The Platform currently processes payments exclusively through Stripe in US Dollars, but we may in the future support additional payment methods, including but not limited to other payment processors, digital wallets, cryptocurrencies, or other digital assets.
Any such alternative payment methods will be subject to: (a) Additional verification requirements as needed to comply with applicable laws; (b) Compliance with all relevant anti-money laundering (AML) and know-your-customer (KYC) regulations; (c) Screening against sanctions lists maintained by OFAC and other relevant authorities; (d) Potential processing delays for enhanced due diligence; (e) Additional fees or charges as determined by the payment method provider.
8. DISPUTES AND RESOLUTION
8.1 Dispute Filing
Fans may file disputes if they believe a Creator has not fulfilled a request as agreed. Disputes must be filed within 14 days of the request being marked as fulfilled.
8.2 Dispute Process
Upon receiving a dispute, the Platform will review all available evidence, including communications between the Fan and Creator. The Platform's decision on disputes is final and binding.
8.3 Communication Decryption
In the event of a dispute, the Platform reserves the right to decrypt and review communications between the Fan and Creator to determine the facts of the case.
8.4 Dispute Resolution Timeline
The Platform aims to resolve disputes within 7-14 business days of filing. Complex disputes may take longer to resolve.
8.5 Dispute Outcomes
Dispute outcomes may include: a) Full refund to the Fan; b) Partial refund to the Fan; c) No refund (dispute resolved in favor of Creator); d) Additional requirements for the Creator to fulfill the request.
8.6 False Dispute Penalties
Filing false or frivolous disputes is prohibited and may result in: a) Account suspension or termination; b) Forfeiture of disputed funds; c) Ban from future use of the Platform.
8.7 Instagram-Specific Dispute Resolution
For any disputes specifically related to the display of Instagram profile information on our Platform:
1.Initial Resolution: We offer an expedited resolution process via instagram-disputes@anyonehasaprice.com with a guaranteed response within 48 hours.
2.Mediation: If the dispute cannot be resolved directly, we offer mediation through an independent third-party mediator at our expense.
3.Documentation: We will maintain records of all Instagram-related disputes and their resolutions for a minimum of three years.
4.Non-Retaliation: We will not take any adverse action against users who raise legitimate concerns about Instagram profile display.
9. INTELLECTUAL PROPERTY
9.1 Content Ownership
Creators retain ownership of all Content they create in fulfillment of requests. By using the Platform, Creators grant the Platform a non-exclusive, worldwide, royalty-free license to use, display, and distribute their Content solely for the purpose of operating the Platform.
9.2 Limited License to Platform
By posting Content on the Platform, you grant the Platform a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such Content solely for the purpose of operating the Platform.
9.3 Copyright Infringement
The Platform respects the intellectual property rights of others. If you believe your copyright has been infringed, please contact us with information sufficient to identify the allegedly infringing content.
9.4 DMCA Compliance
The Platform complies with the Digital Millennium Copyright Act (DMCA). We will remove Content that infringes copyright upon proper notification.
9.5 Instagram Profile Pictures and Content
All Instagram profile pictures, usernames, and other profile information displayed on the Platform remain the intellectual property of their respective owners. We display this information under fair use principles solely for identification purposes. We claim no ownership rights over any Instagram profile content displayed on our Platform.
10. PRIVACY AND DATA
10.1 End-to-End Encryption
All communications between Fans and Creators on the Platform are end-to-end encrypted. The Platform cannot access these communications except in the case of a dispute, as described in Section 8.3.
10.2 Data Sharing for Chargebacks
If a Fan initiates a chargeback through their payment provider, the Platform reserves the right to share all available data with the Fan's bank or payment provider to defend against the chargeback. This includes, but is not limited to, communications between the Fan and Creator, transaction details, and any other relevant information.
10.3 Data Collection and Use
The Platform collects and uses data as described in our Privacy Policy. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.
10.4 Data Security and Maximum Security Focus
PLATFORM SECURITY IS OUR PRIMARY FOCUS. The Platform takes reasonable measures to protect the security of your data. We implement industry-standard security measures including: a) End-to-end encryption for communications b) Secure payment processing through certified providers c) Regular security audits and updates d) Data minimization practices e) Secure server infrastructure
However, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee the absolute security of your data.
10.5 Instagram Data Usage and Limited Data Collection
LIMITED DATA COLLECTION: The Platform displays publicly available information from Instagram accounts for the sole purpose of facilitating connections between Fans and potential Creators. WE COLLECT ONLY THE MINIMUM DATA NECESSARY FOR PLATFORM OPERATION:
WE COLLECT AND DISPLAY: a) Instagram profile pictures (for identification only) b) Instagram handles (for identification only) c) Basic account information required for platform functionality d) Payment information (processed through third-party providers)
DATA MINIMIZATION: We are committed to minimizing the Instagram profile data we display. We limit our collection and display to:
1.Public username
2.Public profile picture (thumbnail only)
3.Public account name
4.Public account category/type (if applicable)
WE DO NOT COLLECT, STORE, OR DISPLAY:
1.Instagram posts or content
2.Stories or highlights
3.Follower or following lists
4.Comments or engagement metrics
5.Any non-public information
DATA CURRENCY: To ensure the accuracy of displayed information, we regularly refresh public profile data to reflect any changes made by Instagram users to their public profiles. 3.Prevents re-display of removed profiles
4.Regularly audits our systems for compliance with these Terms
5.Adapts to changes in applicable laws and platform policies
We do not claim ownership of any Instagram data displayed on our Platform, nor do we imply any relationship with or endorsement by the individuals whose information is displayed.
10.6 Geographic Compliance
GEOGRAPHIC COMPLIANCE: We recognize that laws regarding data privacy, publicity rights, and profile display vary by jurisdiction. In addition to our standard protections:
1.European Economic Area (EEA) and UK: For Instagram users located in these regions, we provide additional rights under GDPR, including data access, rectification, and erasure. Requests can be submitted to gdpr@anyonehasaprice.com.
2.California: For Instagram users located in California, we provide additional rights under the CCPA/CPRA, including the right to know, delete, and opt-out of the sale of personal information. Requests can be submitted to ccpa@anyonehasaprice.com.
3.Other Jurisdictions: We respect and comply with applicable local laws regarding publicity rights, data protection, and privacy in all jurisdictions where we operate. Users may contact legal@anyonehasaprice.com with jurisdiction-specific inquiries.

11. LIMITATION OF LIABILITY
11.1 Platform Role
The Platform is a facilitator of connections and transactions between Fans and Creators. The Platform is not responsible for the actions or content of Fans or Creators.
11.2 Creator Authenticity and Identity Verification Disclaimer
CREATOR AUTHENTICITY DISCLAIMER: THE PLATFORM DOES NOT VERIFY THE IDENTITY OF INSTAGRAM USERS WHOSE PROFILES ARE DISPLAYED. WHILE WE REQUIRE INSTAGRAM ACCOUNT LINKING FOR REGISTERED CREATORS, WE CANNOT AND DO NOT GUARANTEE THAT:
1.ANY INSTAGRAM PROFILE DISPLAYED BELONGS TO THE PERSON CLAIMED OR IMPLIED;
2.THE PERSON CONTROLLING THE INSTAGRAM ACCOUNT IS WHO THEY CLAIM TO BE;
3.THE INSTAGRAM ACCOUNT HAS NOT BEEN COMPROMISED OR HACKED;
4.THE INSTAGRAM USER IS AWARE OF, HAS CONSENTED TO, OR PARTICIPATES IN OUR PLATFORM.
USERS INTERACT WITH CREATORS AND MAKE OFFERS ENTIRELY AT THEIR OWN RISK. WE STRONGLY RECOMMEND VERIFYING CREATOR IDENTITY THROUGH DIRECT COMMUNICATION BEFORE MAKING SUBSTANTIAL OFFERS.
11.3 Real-Life Meetings and Offer Consequences
THE PLATFORM IS NOT RESPONSIBLE FOR ANY CONSEQUENCES IF A USER DECIDES TO MEET A CREATOR OR ANOTHER USER IN REAL LIFE. SUCH MEETINGS ARE ENTIRELY AT THE USER'S OWN RISK. THE PLATFORM STRONGLY DISCOURAGES USERS FROM MEETING IN PERSON. FURTHERMORE, THE PLATFORM IS NOT RESPONSIBLE FOR ANY REAL-WORLD CONSEQUENCES, ACTIONS, OR OUTCOMES THAT MAY ARISE FROM OR BE RELATED TO ANY OFFER MADE, ACCEPTED, OR FULFILLED THROUGH THE PLATFORM. ALL INTERACTIONS AND THEIR CONSEQUENCES, WHETHER ONLINE OR OFFLINE, ARE SOLELY BETWEEN THE USERS INVOLVED.
11.4 Request Fulfillment and Creator Promises
THE PLATFORM IS NOT RESPONSIBLE IF A CREATOR FAILS TO FULFILL A PAID REQUEST OR FAILS TO MEET ANY PROMISES OR REPRESENTATIONS MADE TO A FAN. WHILE THE PLATFORM PROVIDES A DISPUTE RESOLUTION PROCESS, THE PLATFORM CANNOT GUARANTEE THAT ALL REQUESTS WILL BE FULFILLED TO THE FAN'S SATISFACTION OR AS PROMISED BY THE CREATOR.
11.5 General Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM, INCLUDING BUT NOT LIMITED TO ADVICE GIVEN BY CREATORS, FILES SENT BY CREATORS (INCLUDING VIRUSES OR MALWARE), OR UNAUTHORIZED USE OF ACCOUNTS (INCLUDING HACKED ACCOUNTS); (C) ANY CONTENT OBTAINED FROM THE PLATFORM; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, INCLUDING BUT NOT LIMITED TO SCREENSHOTTING, SHARING, OR LEAKING OF OFFER CONTENT, PRIVATE CONVERSATIONS, OR PICTURES SENT BY CREATORS.
11.6 Limitation of Damages
IN NO EVENT SHALL THE PLATFORM'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO THE PLATFORM, IF ANY, IN THE PAST SIX MONTHS.
11.7 Basis of the Bargain
THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN THE PLATFORM AND YOU.
11.8 Specific Instagram-Related Indemnification
You agree to indemnify, defend, and hold harmless Anyone Has a Price, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all claims, liabilities, damages, and/or costs (including attorneys' fees and costs) arising from or related to:
1.Your interactions with Instagram users discovered through our Platform;
2.Any misrepresentation you make regarding your relationship with Instagram users displayed on our Platform;
3.Any violation of Instagram's Terms of Service that you commit in connection with your use of our Platform;
4.Any claim by an Instagram user that their profile was displayed on our Platform without consent, provided that we comply with our removal procedures upon notification.
12. DISCLAIMERS
12.1 "AS IS" Provision
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
12.2 No Guarantees
THE PLATFORM DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE PLATFORM WILL MEET YOUR REQUIREMENTS.
12.3 Non-Affiliation with Instagram/Meta
Anyone Has a Price is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Instagram, Meta Platforms, Inc., or any of its subsidiaries or affiliates. Instagram and Meta are registered trademarks of Meta Platforms, Inc.
12.4 Profile Display Disclaimer
The display of an Instagram profile on our Platform does not indicate that the individual: a) Is aware of our Platform's existence b) Has registered as a user on our Platform c) Has endorsed, approved of, or has any relationship with our Platform d) Has consented to appear on our Platform e) Has received or accepted any offers through our Platform
12.5 Creator Participation Disclaimer
The Platform makes no representations or warranties about whether any specific Instagram user displayed on the Platform is actively using the Platform or will accept offers. Fans send offers at their own discretion with the understanding that many Instagram users may not be active participants on the Platform.
12.6 Satisfaction Disclaimer
THE PLATFORM DOES NOT GUARANTEE USER SATISFACTION WITH ANY ASPECT OF THE SERVICE, INCLUDING BUT NOT LIMITED TO CREATOR INTERACTIONS, REQUEST FULFILLMENT, OR CONTENT QUALITY. USERS ACKNOWLEDGE THAT SATISFACTION IS SUBJECTIVE AND THE PLATFORM IS NOT RESPONSIBLE FOR ENSURING THAT CREATORS MEET ANY SPECIFIC QUALITY STANDARDS BEYOND BASIC FULFILLMENT OF THE AGREED-UPON REQUEST. THE PLATFORM'S DISPUTE RESOLUTION PROCESS IS LIMITED TO DETERMINING WHETHER A REQUEST WAS FULFILLED ACCORDING TO THE AGREED-UPON TERMS, NOT WHETHER THE FULFILLMENT MET SUBJECTIVE QUALITY EXPECTATIONS.
12.7 Disclaimer Regarding Creator Advice and Content
THE PLATFORM IS NOT RESPONSIBLE FOR ANY ADVICE, OPINIONS, INFORMATION, PROMISES, OR CONTENT PROVIDED BY CREATORS. ANY CONTENT OR ADVICE EXCHANGED BETWEEN USERS IS SOLELY BETWEEN THE INVOLVED PARTIES. THE PLATFORM DOES NOT ENDORSE, VERIFY, OR GUARANTEE THE ACCURACY, RELIABILITY, OR LEGALITY OF ANY SUCH CONTENT OR ADVICE. USERS RELY ON CREATOR CONTENT AND ADVICE AT THEIR OWN RISK.
12.8 Disclaimer Regarding User Conduct and Content Sharing
THE PLATFORM IS NOT RESPONSIBLE FOR THE CONDUCT OF ITS USERS, INCLUDING BUT NOT LIMITED TO THE UNAUTHORIZED SCREENSHOTTING, SHARING, OR LEAKING OF OFFER CONTENT, PRIVATE CONVERSATIONS, OR PICTURES SENT BY CREATORS. USERS ARE SOLELY RESPONSIBLE FOR THE CONTENT THEY CHOOSE TO SHARE AND THE MANNER IN WHICH THEY INTERACT WITH OTHERS ON THE PLATFORM. WHILE OUR TERMS PROHIBIT SUCH ACTIONS, WE CANNOT GUARANTEE COMPLIANCE BY ALL USERS.
12.9 Disclaimer Regarding Account Security and Hacking
WHILE WE IMPLEMENT SECURITY MEASURES, THE PLATFORM IS NOT RESPONSIBLE FOR UNAUTHORIZED ACCESS TO YOUR ACCOUNT, INCLUDING INSTANCES WHERE YOUR INSTAGRAM ACCOUNT OR ANYONE HAS A PRICE ACCOUNT IS HACKED OR COMPROMISED. YOU ARE RESPONSIBLE FOR MAINTAINING THE SECURITY OF YOUR CREDENTIALS AND REPORTING ANY SUSPECTED UNAUTHORIZED ACTIVITY IMMEDIATELY.
12.10 Disclaimer Regarding Files and Viruses
THE PLATFORM IS NOT RESPONSIBLE FOR ANY FILES, INCLUDING THOSE CONTAINING VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS, SENT OR SHARED BY CREATORS OR OTHER USERS. USERS DOWNLOAD OR ACCESS FILES SHARED THROUGH THE PLATFORM AT THEIR OWN RISK AND ARE ADVISED TO USE APPROPRIATE ANTIVIRUS SOFTWARE.
13. FORCE MAJEURE
13.1 Force Majeure Events
Neither party shall be liable for any failure or delay in performance under these Terms (other than for payment obligations) due to circumstances beyond their reasonable control, including but not limited to: a) Acts of God, natural disasters, earthquakes, fires, floods, severe storms, or other natural calamities; b) Pandemic, epidemic, or public health emergencies; c) Terrorism, war, invasion, hostilities, civil unrest, riots, or civil disturbances; d) Strikes, labor disputes, or other industrial disturbances; e) Governmental actions, orders, restrictions, regulations, or interventions; f) Power failures, internet or telecommunications failures or outages; g) Cyberattacks, hacking incidents, or other similar events; h) Any other similar events or circumstances beyond the reasonable control of the affected party.
13.2 Notification and Mitigation
The affected party shall: a) Provide notice to the other party as soon as reasonably practicable; b) Take reasonable steps to minimize the impact and resume performance; c) Keep the other party informed about progress in remedying the situation.
13.3 Extended Force Majeure
If a force majeure event continues for more than 30 consecutive days, either party may terminate any affected services upon written notice. In such case, Fans will receive refunds for any unfulfilled requests, and Creators will receive payment for any completed work.
13.4 Limitation
Force majeure shall not excuse payment obligations for services already rendered or relieve either party from compliance with laws or regulations applicable to their performance under these Terms.
14. MANDATORY ARBITRATION AND CLASS ACTION WAIVER
14.1 Mandatory Arbitration
ALL DISPUTES ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM MUST BE RESOLVED THROUGH BINDING ARBITRATION. Users waive their right to pursue claims in court or before a jury. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration.
14.2 Class Action Waiver
USERS EXPRESSLY WAIVE THEIR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS, CLASS ARBITRATIONS, OR ANY COLLECTIVE LEGAL PROCEEDINGS. All disputes must be resolved individually through arbitration. You may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.
14.3 Arbitration Procedures
Arbitration shall be conducted under the rules of the American Arbitration Association in Wyoming, USA. The arbitrator's decision shall be final and binding. The arbitration will be conducted by a single arbitrator, and the arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
14.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
15. TERM AND TERMINATION
15.1 Term
These Terms shall remain in full force and effect while you use the Platform.
15.2 Termination by You
You may terminate your account at any time by following the instructions on the Platform or by contacting us.
15.3 Termination by Platform
The Platform may terminate or suspend your account at any time for any reason, including but not limited to, violation of these Terms. Upon termination, your right to use the Platform will immediately cease.
15.4 Effect of Termination
Upon termination, all provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
16. GOVERNING LAW AND JURISDICTION
16.1 Governing Law
These Terms shall be governed by the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
16.2 Jurisdiction
Any dispute arising from or relating to these Terms or the Platform that is not subject to arbitration shall be resolved exclusively in the state or federal courts located in Wyoming, USA. You consent to the personal jurisdiction of such courts.
16.3 Arbitration Preference
Notwithstanding the foregoing, the Platform may elect to resolve any dispute through binding arbitration in accordance with the American Arbitration Association's rules as described in Section 14.
17. GENERAL PROVISIONS
17.1 Entire Agreement
These Terms constitute the entire agreement between you and the Platform regarding the use of the Platform and supersede all prior agreements and understandings.
17.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
17.3 No Waiver
The failure of the Platform to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without the Platform's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. The Platform may assign or transfer these Terms, at its sole discretion, without restriction.
17.5 Notices
Any notices or other communications provided by the Platform under these Terms will be given by posting to the Platform or by email to the address you provide.
